Overview

This website is operated by PERKii Pty Ltd. PERKii offers this website to you, the user, conditional upon your acceptance of all terms and conditions stated here.  By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms”). These Terms apply to all users of the site, including users who are browsers, vendors, customers, merchants, and/ or contributors of content.  If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

Online Store Terms

By agreeing to these Terms, you (i) represent that you are at least the age of majority in your state or province of residence, (ii) agree not to use our products for any illegal or unauthorised purpose, (ii) agree not to transmit any worms or viruses or any code of a destructive nature and (iv) agree that any breach or violation of any of the Terms will result in an immediate termination of Services.

General Conditions

We reserve the right to refuse service to anyone for any lawful reason at any time.  You understand that your content (not including credit card information), may be transferred unencrypted and involve transmissions over various networks and changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

Refund and Returns Policy

We do not refund for change of mind, however our goods do come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major fault or failure. You are also entitled to have the goods or replaced if the goods fail to be of acceptable quality.

Damages and issues

Please inspect your order upon reception and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right.

Subscriptions

When you purchase a subscription you'll receive repeat deliveries. These are based on the subscription duration and frequency that you select.

Your payment details will be stored securely and you'll be charged for each of these deliveries, unless you choose to pay in advance. Some subscriptions may auto-renew at the end of their duration. If you don’t want to renew a subscription you can cancel it.

If you want to cancel or change your subscription, you can do it at any time. Your order confirmation emails have links to your order. You can manage your subscription from there.

Privacy Policy

What do we do with your Information? When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.

When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

Email marketing: With your permission, we may send you emails about our store, new products and other updates.

SMS marketing: With your permission, we may send you SMS messages about our store, new products, promotions and other updates. 

Consent

How do you get my consent?

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only. If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

How do I withdraw my consent?

Disclosure

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

Shopify

Our store is hosted on Shopify. They provide us with the online e-commerce platform that allows us to sell our products and services to you. Your data is stored through Shopify's data storage, databases and the general Shopify application. 

Payment

If you choose a direct payment gateway to complete your purchase, then Zoho Commerce stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

Third-party Services

In general, the third-party providers we use will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us. 

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

Security

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption.  Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

A cookie is a string of information that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns. We use cookies to help us identify and track visitors, their usage of the PERKii Probiotics website, and their website access preferences. PERKii Probiotics visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using our website, with the drawback that certain features may not function properly without the aid of cookies.

Changes to this Privacy Policy

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.

If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.

Severability

In the event that any provision of these Terms is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms, such determination shall not affect the validity and enforceability of any other remaining provisions.

Termination 

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

Entire Agreement

The failure of us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.  These Terms and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any other agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms).

Governing Law

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Queensland, Australia.

You can review the most current version of the Terms at any time at this page.  We reserve the right, at our sole discretion, to update, change or replace any part of these Terms by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms constitutes acceptance of those changes.

1. The promoter is: PERKii Pty Ltd whose registered office is at Level 7, GP South Building, St. Lucia, 4067, Queensland.

2. The competition is open to residents of Australia, except employees of PERKii, and their close relatives and anyone otherwise connected with the two organisations or judging of the competition.
3. There is no entry fee and no purchase necessary to enter this competition.
4. By entering this competition, an entrant is indicating his/her agreement to be bound by these terms and conditions.

8. Facebook in no way endorses or promotes the competition. 
9. Multiple entries accepted per account.
10. Closing date for entry will be the day prior to annoucement, 04/02/2021 at 23:59 AEST. After this date and time, no further entries to the competition will be permitted.
11. 3 winners will be determined at random by a representative of PERKii, and contacted on 05/02/2021. They will have 28 days to respond, or else a new winner will be selected.
12. Delivery Ts and Cs apply, based on current coverage of PERKii delivery. If for any reason a location for delivery cannot be determined, or a suitable location not currently serviced, a new winner may be selected.
13. No responsibility can be accepted for entries not received for whatever reason.
14. The prize consists of 3 cases of PERKii Sparkling (36 drinks). 3 prizes to be sent in total.
15. Entry into the competition will be deemed as acceptance of these terms and conditions.
16. This promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram, Facebook, Twitter or any other Social Network. You are providing your information to PERKii and not to any other party. The information provided will be used in conjunction with the following Privacy Policy found above.
